Terms and Conditions
1.1 Catsolar 2008 s.l. or Sitges Luxury Villas as a commercial name, acts as mediator on behalf of the owner of the accommodations of the holiday villas. The contract is made between the person making the reservation and the mediating company.
1.2 In these terms and conditions of reservation, “you” and “your” mean the holiday guest and all persons named in the reservation (including any person who is added or replaced at a later date) or any of them as appropriate for the context. The “Owner” refers to the owner (s) of the property you reserve or wish to book through Sitges Luxury Villas or another person (s) who can legally sign a contract with you for the rental of the property in accordance with these reservation conditions. . “Owners” means all owners and other persons whose properties (“properties” or “property”) are marketed by Sitges Luxury Villas.
1.3 Catsolar 2008, sl acts only as a mediator for the owners. When making a reservation for a property, a contract will be made with Catsolar 2008 s.l. and the client for the use of the property.
1.4 Reservations are only available in relation to the accommodation and do not include any flight, transport or transfer to the establishment.
2.1 All reservations are subject to these booking conditions. When requesting that we make a reservation with the Owner, the vacation guest confirms that he / she and all the persons named in the reservation have read, understood and accepted these terms of the reservation, and conditions. The main name must be at least 25 years old, be a member of the party occupying the property and confirm that he / she is authorized to make the reservation based on these terms and conditions of reservation. Reservations of groups of young people under 20 years can not be accepted. The main name is responsible for making all payments due with respect to the reservation.
2.2 Reservations made through our website or in Spain Holiday.com are not confirmed until we have processed the payment and we send a confirmation of the reservation by email. The payment terms may vary depending on the website where the reservation was made (Airbnb, HomeAway or Trip Advisor).
2.3 To confirm your reservation, a deposit of 40% of the rental fee is required.
2.4 When the vacation guest has special needs, such as a property suitable for disabled people or any other specific requirement, we will try to satisfy them accordingly. These requirements must be specified at the time of booking. Catsolar 2008, s.l. can not accept responsibility for special needs, unless specified during the reservation and the confirmation is granted. If you suffer from allergic reactions, keep in mind that although certain properties are advertised as NOT allow pets, we can not guarantee that pets have never been in that property and can not be held responsible in such circumstances. Also note that the intensity of the winter and the humidity of the spring and the location of the property determine the number of mosquitoes and other insects in the summer. It is your responsibility to take measures to protect yourself as necessary, for example, apply mosquito lotion or buy mosquito plugs or other products if necessary. Catsolar 2008, sl or the Owner are not responsible for the presence of mosquitoes or other common insects in the area and / or for any resulting inconvenience.
2.5 60 days before the arrival date, the remaining 30% of the rental rate will be paid, and the other 30% will be paid on the day of arrival by cash. The refundable damages deposit must be paid before the entry to the establishment by transfer or credit card before arrival, or cash on the day of arrival. Cleaning and tourist tax fee will be paid upon arrival by cash. If you do not make these payments on time, we may cancel your reservation and lose your deposit. The Owners contractually obligate us not to allow access to the property unless we have received all payments in full.
2.6. Water, gas and electricity are included in May, June, July, August and September. The supplements apply where it is clearly established.
2.7 Confirmed reservations can be canceled. Please, read carefully the conditions of cancellation of the web where you made your reservation. If you made your reservation through Spain Holiday or with Sitges Luxury Villas, please read the terms and conditions established in the rental agreement.
3.1 Prior to your arrival, please indicate your correct arrival time so that we can plan your check-in. You must keep our service team informed of any changes or delays. Our service team will have your contact number and email address in case we need to contact you regarding your arrival time. 3.2 Before your arrival, we will send you an email with instructions to get to the establishment, and set the arrival times.
3.3 On the day of your arrival, you must call our service team when you leave the airport (or 1 hour before arriving at your rental property if you arrive by car). The property will be available from 4pm. However we will always try to accommodate customers who arrive early if possible. (When booking flights, keep in mind what time you arrive at the establishment.) During the high season, the previous guests leave the establishment at 10:00 and then the establishment must be cleaned and prepared for you. Access to the property during the High season is not possible in most cases and, therefore, should not be expected.)
3.4 Registration is between 4pm and 10pm. The late check ins must be informed in advance and have an additional cost of € 40.
4.1 On the day of departure, you must leave the rental property before or at 10 am. Failure to comply with these deadlines may result in additional charges for a partial or total extended stay. If you need to leave the property later, ask if this is possible at check-in or when booking. If possible, you can stay until 6 pm, but this will be subject to an additional charge of 50% of the rental price per night. Leaving at any time after 6 pm will incur an additional charge corresponding to the total rental price per night.
4.2 The day of your departure, you must leave the property clean and tidy, wash the dishes or leave them in the dishwasher (start the dishwasher), clean the oven and barbecue (if used), replace the furniture where they are on arrival and all waste (garbage) disposed of correctly. Keep in mind that we will have to charge additional cleaning costs for not complying with the above. Leaving the Villa in bad conditions of garbage or disorder can generate a penalty of 100 € or will be charged the cost that the cleaning company charges for cleaning it. Excessive consumption in domestic services may cause an additional charge. Responsible consumption is required for the proper functioning of the villa services and respect for the environment.
4.3 We will retain items of property lost for only 28 days from the date of departure. Items that will be returned will be charged at a fixed rate of € 20 plus the package and shipping. We do not accept the responsibility of returning any item and we do not return any food or drink.
- TOWELS AND SHEETS
5.1 We offer free 1 set of sheets ,Bath and pool towels for each guest.
5.2 Please DO NOT remove towels and other items from the rental property ( towels are NOT allowed to be taken to the beach).
6.1 Garden and pool maintenance is included in your reservation and is often done very early in the morning to minimize interruptions for you. (The maintenance schedule of the pool / garden is usually indicated in the guest information folder on the property).
6.2 Reservations do not include daily cleaning, laundry, transportation, catering or food. However, this can be contracted at an additional cost. Contact our service team at firstname.lastname@example.org or email@example.com for more information.
6.3 We also offer a wide variety of additional services, for example: babysitter, housekeeper, boat trips, excursions in the Garraf Natural Park, cellar visits, bicycle rental facilities, private barbecues, homemade paella cooked in the villa, food purchase services, cakes of birthdays and much more. If you are looking for something in particular and need help, let us know as soon as possible and we will be happy to help.
- NUMBER OF PEOPLE
7.1 Each property has a recommended number of people who can sleep on the property. Subject to the configuration of each property and the conditions established by the Owner, we will try to satisfy your request to install additional beds. There will be an additional cost per additional bed installed. Please discuss the costs and suitability with our reservation department.
7.2 We prepare the beds for the number of people confirmed in the booking form. No other person is allowed to sleep on the property without prior agreement. Occasionally, guests may visit with you the property without the prior agreement of the Owner, provided that the number of additional guests in the property does not exceed 4 persons and the additional guest meets the reservation conditions established in this document and the rules of the house
- ALTERNATIVE ACCOMMODATION
8.1 Occasionally, it may be necessary to make a substantial change in vacation arrangements for reasons such as the removal of a property from the Sitges Luxury Villas portfolio, flood damage, building maintenance or other unforeseen circumstances. In this case, Sitges Luxury Villas will endeavor to offer an alternative property of a comparable standard and price to the holiday guest. If the only alternative property is a higher price, SLV reserves the right to collect the difference. The vacation guest has the right to refuse the alternative property for any reason (for example, price, inadequacy, etc.) in which case SLV will retturn the total amount paid, but no other compensation will be paid. The responsibility of SLV is limited to, and can not exceed, the amount paid by the vacation guest.
8.2 Be sure to read the description of the property carefully. If you have any questions or special requirements, let us know. We have individual rental agreements with the Owners and we can not exchange clients between properties.
- CUSTOMER RESPONSIBILITIES
9.1 You must maintain the property and all the furniture, contents, accessories, facilities, equipment, land and any pool in the same conditions as at the beginning of the holidays, and in the same state of cleanliness and general order in which they were found. .
9.2 You will be responsible for the payment of any breakage, loss or damage to the property or its contents caused by you or by any person that invites or allows you to enter the property.
9.3 As a matter of courtesy to the owner, we expect you to let our staff know about any damage caused.
- RIGHT OF ENTRY
10.1 The Owner or a staff member of Catsolar 2008, sl can inspect the property at any time during their stay, as long as there is a member present in their group, or with the guest’s permission in case they are not in the villa in that moment. In the event of an emergency, the Owner / manager / designated repair person may enter the property to make repairs and maintenance.
10.2 Catsolar 2008, sl and its representatives reserve the right to refuse admission or entry to the property for all or any person, and may demand that all or any person leave the property, without refund, to those who consider that they are in a serious violation of these conditions. This includes people who cause inconvenience or damage to holiday accommodation or behave in an offensive or disorderly manner. In such case, Catsolar 2008, sl will not be responsible for making any payment to the holiday guest and will retain all the money paid by the Holiday Guest.
- DAMAGE DEPOSIT
11.1 The damage deposit paid in accordance with Clause 2.5 will generally be refunded via bank transfer within five business days of your return from vacation, unless deductions are required. (Note that if a damage deposit was paid by credit card, therefore, it is returned through the same method, the time when the relevant funds are unlocked in your account depends on the conditions of your personal bank. The time can vary between 1 week and for some banks up to 1 month.)
11.2 If the control staff of Catsolar 2008 s.l. and / or the owner identify any damage to the rental property or its contents, accidental or deliberate, including the loss of any item, we will inform you. Then we will discuss with the Owner the best way to rectify said damage or loss. Note that Catsolar 2008 s.l. will do everything possible to correct any internal damage before hiring specialists to perform repairs and, therefore, will do everything possible to keep the costs incurred by you to a minimum. Keep in mind that delays may occur while waiting for utility bills or proof of damages / the cost of repairing or replacing damaged, broken or lost items.
11.3 Any damage to the rental property or its contents, accidental or deliberate, including the loss of any item, must be paid in full by you. The Owner is entitled to claim such sums from the person responsible for the reservation or from any other member of the party without having to prove that they were personally responsible for the damages, losses or breakages. We recommend that you obtain adequate insurance to cover this responsibility. Initially, we will deduct the relevant costs of your damage deposit. Any cost not covered by your deposit must be paid in full within 7 days of the request for payment by Catsolar 2008 s.l. and / or the owner’s items. In the case of payments by credit card, the corresponding amount will be deducted. Any amount of damage deposit left after deductions will be refunded as soon as we can.
11.4 The damage or loss may not be immediately apparent to the Owner at the time of departure. The Owner reserves the right to charge you for any damage or loss noted on the property after your departure.
11.5 When the owner so requests, we reserve the right to withhold any damage deposit on your behalf for longer if there is a dispute for damages or losses, or we are waiting for bills or proof of damages / the cost of repair or replacement.
11.6 We act only as a mediator. Any complaint or other problem that you may have regarding the Deposit for damages or any deduction from the Deposit for damages should be addressed directly to the Owner. We can not accept any responsibility or enter into negotiations regarding this aspect of your contract with the Owner. We act only under the instruction of the owner.
11.7 If a claim must be filed against the Deposit for damages, Catsolar 2008 s.l. will apply a fixed administration fee of € 25. If Catsolar 2008 s.l. You have to buy a relocation item, an additional charge of € 50 will be applied to cover the cost of the displacement and a purchase fee.
12.1 We hope you have a great time and enjoy the outdoors. However, keep in mind your neighbors. High music and parties are strictly prohibited. In accordance with local laws and regulations, noise should be kept at a minimum between 11 pm and 10 am. We would appreciate your full cooperation in this matter and we hope you understand that these rules are necessary, since your rental property is located in a residential area with people who have to get up early and go to work. Therefore, the silence time at night for neighbors must be respected. By submitting this form, you agree to behave responsibly and correctly on behalf of your accompanying party, as well as yourself. If you or any of your accompanying party behaves in an inappropriate and incorrect manner, we reserve the right to ask you and your accompanying party to leave the rental property. From that moment on, you will not be entitled to any future claims or any type of compensation, and you will forfeit all payments made, including rental expenses and deposit.
- AIR CONDITIONING AND FANS.
13.1 We want you to feel as comfortable as possible, however, we kindly ask you to use the fans and / or air conditioning units wisely and safely. Turn them on only when necessary, and turn them off, especially when leaving the property. For air conditioning units (if applicable), doors and windows must be closed for the units to function properly. Units should not be left on continuously as this will cause the units to burn or consume disproportionate amounts of electricity. Any damage resulting from the abusive use of fans / air conditioning units will be deducted from the Damage Deposit.
- POOLS AND GYMS.
14.1 If your rental period is outside of May to September, check with us that the pool will be available, full and ready for use. The pools are not heated unless otherwise indicated.
14.2 Please note that swimming pools carry their own inherent risks. Upon arrival at the property, you should take time to familiarize yourself with the location, design and depth of any pool on the property. Take note of the instructions for use that can be displayed. Small children should not be allowed to walk alone on the grounds of any property where there is a pool. You are responsible for the safety of the pool users at all times. Children should be supervised properly at all times while using it or in the vicinity of any pool.
14.3 For reasons of hygiene, make sure that all pool users bathe before using the pool and that children use the bathroom before swimming.
14.4 Observe the safety of the pool at all times: do not immerse yourself in the pool, do not swim under the influence of alcohol and do not engage in hazardous activities.
14.5 For safety reasons, the use of glass in any form near or directly in the pool is strictly prohibited.
14.7 Gyms are used at their sole discretion and responsibility. Children under 16 are prohibited from entering and using the gym.
15.1.Smoke only outside or on terraces and dispose of cigarette butts properly and safely.
16.1 Pets are not allowed unless permission has been specifically granted.
16.2 If permission has been granted, pets are not allowed in soft furniture (sofas or beds) or in the pool. At the departure date, the garden must be clean. Additional cleaning charges may apply.
- COMMERCIAL ACTIVITIES
17.1 No commercial activity, including commercial filming or photography, can be carried out on the premises without prior written agreement. If you need the property for commercial purposes, please contact us for more information.
18.1 We act only as a mediator for the Owner. We can not accept any liability for any act (s) or omission (s) of the Owner or any person represented, employed, contracted or otherwise by the Owner. In addition, we can not accept any responsibility for any defect or on any property, since all properties are under the exclusive control of the Owners.
18.2 Our maximum liability to you if we are found guilty in connection with any service we provide is limited to the commission we have earned or should be earned in connection with the reservation in question.
18.3 The Owner or Catsolar 2008, s.l. or third parties hired by the Villas do not accept any responsibility for any loss, damage or consequential personal injury as a result of their stay in the rental property. No responsibility is accepted for items belonging to guests that are damaged, lost or stolen from the rental property. Items that belong to guests are not insured by us and we recommend that you have your own vacation insurance for your belongings.
18.4 The Owner and Catsolar 2008, s.l. they are not responsible for noise or disturbance that originates beyond the property boundaries or that is beyond the control of the Owner. In the event that there is a reasonably evident source of noise before your arrival and we are informed of this, we will endeavor to contact you to inform you of the disturbance.
18.5 The Owner and Catsolar 2008 s.l. are not responsible for the breakdown or technical problems of mechanical equipment, such as pumps, boilers, filtration systems of swimming pools or domestic equipment, nor for the failure or lack of availability during a period of time of public services such as water, gas and electricity.
18.6 The Owner and Catsolar 2008, s.l. they are not responsible for any event or circumstance that is beyond their control or the consequences of such event or circumstance, including any loss or consequential damage.
18.7 Overwhelming force: Catsolar 2008, s.l. will not be responsible for changes, cancellations or any other effect on holidays, due to any event, which with all due attention can not be foreseen or avoided.
18.8 We will do everything in our power to make sure that the details of the property description are correct and as accurate as possible. We will not assume any responsibility for any error or omission that may occur. The distances and measurements are approximate. The facilities available are correct at the time of publication and can not be guaranteed. You can not accept responsibility for the weather, the natural or built environment, local conditions, traditions or practices, the interruption of any service, including public services, the supply of water and electricity and any consequent effect thereof. We reserve the right to change the information published on the website at any time, including prices, descriptions and photos.
19.1 We have a friendly personal relationship with guests. We rarely receive a complaint; however, it is important to inform you of the correct procedure. If you find any problem or malfunction in the rental property, you MUST call our attention during your stay. This gives us the opportunity to rectify the matter quickly. Any complaint received after departure will not be accepted. You must contact our service team, preferably by email to firstname.lastname@example.org or email@example.com , who will contact the Owner to try to resolve the problem as soon as possible.
19.2 Claims received at the end of the holidays will not be accepted.
- TERMS AND CONDITIONS
20.1 We reserve the right to update any of these booking conditions at any time if deemed necessary and in the interest of the company.
20.2 All additional terms and conditions that apply to a particular rental property are set out in the house rules and Additional information on the villas forms part of these booking conditions. The rules of the house and additional information about the villa can be found in the information folder for guests of the establishment and are also available upon request.
